History of Crime and Punishment

A presente contribuição oferece uma análise crítica das teorias neomarxistas da punição. A primeira parte do texto reconstrói duas perspectivas que emergiram da tradição criminológica materialista: (1) as chamadas “histórias revisionistas da punição” dos anos 1970, que revelaram as conexões históricas entre a emergência da pena moderna – isto é, a transição dos medievais “espetáculos de sofrimento” para a prisão disciplinar – e a consolidação de um sistema capitalista de
produção baseado na exploração do trabalho; (2) a crítica neomarxista da pena contemporânea, que desenvolveu mais o cenário marxista em uma tentativa de dissecar as relações estruturais entre as transformações no campo penal e processos contínuos de reestruturação do capitalismo neoliberal. A segunda parte, endereça algumas críticas que têm se desenvolvido contra a perspectiva materialista – i.e., sua tendência em ignorar as dimensões político-institucionais das penas, sua relativa falta de atenção às dinâmicas racializadas da acumulação capitalista, e uma excessiva ênfase aos sentidos instrumentais das práticas penais às custas das dimensões simbólicas da punição. A terceira seção indica alguns dos desafios enfrentados pelas teorias neomarxistas da punição hoje, visualizando
– ao longo dos recentes estudos sobre o poder carcerário sob o capitalismo racial – algumas possíveis novas direções de pesquisa em um cenário crítico mais amplo, focado na interseção entre raça e classe como forças poderosas na reprodução do capitalismo.

Il contributo prende spunto dall’introduzione del reato di tortura nel codice penale italiano e dal dibattito sulla possibile ammissibilità della tortura come strumento estremo di contrasto al terrorismo, diffusosi in particolare negli Stati Uniti dopo l’11 settembre, per ripensare come la dottrina medievale ha fondato e giustificato la quaestio per tormenta. In particolare, poiché le fonti descrivono la tortura come mezzo per scoprire la verità estraendola forzosamente dal corpo dell’imputato, saranno analizzati il significato di veritas processuale cui l’interrogatorio doloroso può condurre e il nesso, religioso e culturale, tra verità, corpo e dolore. Fallace e pericolosa ma necessaria, la tortura era una manifestazione di potere, che tuttavia rinviava a discorsi, pratiche (come la confessione sacramentale) e iconografie radicati nella mentalità dell’uomo medievale, così come oggi gli argomenti giuridici del ticking bomb e le immagini dei corpi torturati a Guantanamo o Abu Grahib fanno leva sulla cultura della paura e sulla disumanizzazione del nemico.

Współcześnie osoby winne dzieciobójstwa są karane dużo łagodniej niż w wiekach wcześniejszych. Celem niniejszego artykułu jest ukazanie tego zjawiska na podstawie wzmianek w księgach kryminalnych prowadzonych w Żywcu, Wiśniczu oraz Dobczycach. Autorka próbuje także ukazać różnice w traktowaniu oskarżonych w poszczególnych miastach i otaczających je terytoriach. Podjęto również próbę rozpoznania czy stosunek do dzieciobójczyń zmienił się na przestrzeni wieku XVIII.

The essay analyses constitutional problems raised, first, by criminological reformism of the 1920s, focusing on drafts or laws and, then, by the claim of an authoritarian criminal law formulated by Nazi juristsin 1933. After Dahm’s and Schaffstein’s manifesto, the reaction of manycriminal law scholars, included some reformers such as Grünhut and Radbruch, reveals how the scientific debate was shifting from the struggle between different opinions regarding criminal law theories into a constitutional level grounded on a radical rethinking of the state, its foundations and purposes. A comparison between some points of Italian Fascist criminal law and Nazi reforms and theories shows the peculiarity of the German totalitarian penal system and its radical discontinuity with the liberal paradigm.

This paper explores the semantic colourings, (inter-)textual embedding and subject matters in which the term poena occurs in Roman legal sources of Late Antiquity. It probes its conceptual evolution within the purview of criminal law, including domestic and ecclesiastical penal practices as well as extra-judicial dispute settlement embracing the characteristic multi-normativity of the period. I seek to discern the historic progression of the term and its representations as synchronic actualisations of punishment and atonement, and probe to which extent penal strategy, philosophy of pain and soteriology came to bear on its development and apperception. I focus primarily on a selection of texts from the Theodosian Code and the writings of early Christian authors, whose textual meaning I analyse through the theory of corpus linguistics. The resulting methodology used for the study of historical legal texts allows me to scrutinise changes in register and provides empirical data for potential concurrent dichotomies as well as for the diachronic progression of key concepts signified by the term poena.

This paper examines medieval crime, particularly witchcraft (the concept of the corruptible woman) and its brutal punishments from a historical and psychological perspective. The two prompts answered are in this paper are-

Historically, punishment was directed at the disadvantaged. The rule of law is supposed to ensure that everyone is equal before the law, regardless of things like wealth. How is it then that we still see the criminal sanctions being applied to disadvantaged individuals.

Punishment is the least effective means of changing behavior, yet the criminal justice system relies heavily on the notion of deterrence.

Two broad approaches towards confiscating the proceeds of crime have developed since the conception of using confiscation as a response to acquisitive crime—the punitive approach and the deprivatory approach. The Hodgson Committee in 1984 intended asset confiscation to operate in a deprivatory manner. However, the asset confiscation regime which has emerged in the UK is manifestly punitive in certain respects. This is because the legislative framework artificially inflates the amount of collectible assets in the quantification of criminal benefit and the courts have developed an unrealistic approach towards calculating the available amount. Fifteen years after the Proceeds of Crime Act 2002 was enacted, the confiscation regime is proving ineffective. In 2016, £1.9 billion remained uncollected. The solution lies in a return to a more realistic conception of the confiscation regime as a deprivatory rather than a punitive approach to acquisitive crime.

El objetivo de este artículo es indagar la Revista Penal y Penitenciaria, el “órgano de difusión” de la Dirección General de Institutos Penales de Argentina, desde su conformación en 1936 hasta el advenimiento del peronismo en 1946, cuando inició una nueva etapa. La revista se consagró como un instrumento clave de la burocracia carcelaria por más de cincuenta años, trascendiendo la gestión de los gobiernos conservadores. En este trabajo, argumentaremos que la revista cumplió un rol central para comprender la modernidad de esta agencia en sus primeros años y constituyó la principal herramienta para los funcionarios: difundió la obra de gobierno, comunicó las medidas implementadas tanto a nivel nacional como provincial, motorizó debates entre expertos y funcionarios, y constituyó un medio relevante para informar las transformaciones legales y legislativas.

El objetivo de este trabajo es examinar la Revista Penal y Penitenciaria, órgano oficial de la Dirección General de Institutos Penales, desde 1946 a 1953 para comprender el lugar que ocupó en la reforma carcelaria justicialista. Nuestro análisis finaliza en 1953 debido a que los números correspondientes a los años 1954 y 1955 fueron editados en abril de 1958, y su contenido no pertenece a la gestión peronista. De esta forma, dividimos este artículo en dos secciones: por un lado, nos concentraremos en los inicios de la revista en 1936 para comprender sus objetivos principales, secciones y características a fin de iluminar continuidades y rupturas entre la administración conservadora y la peronista; por otro lado, buscaremos dilucidar el rol que tuvo la publicación en la difusión de la reforma penitenciaria del peronismo clásico.

Este trabajo analiza la edición del Boletín de la Biblioteca Nacional de Criminología y Ciencias Afines, publicación dirigida por Eusebio Gómez, director de la Penitenciaría Nacional de Buenos Aires (1923-1928). Los escritos publicados en la revista nos permitieron comprender el contexto ideológico e institucional sobre el cual se pensó la administración penitenciaria en Buenos Aires durante los años veinte. La relectura de las producciones de Gómez a través de las revistas criminológicas previas revela la centralidad de la Penitenciaría Nacional como referencia de la cuestión penitenciaria local.
