This volume aims to honour the memory of Jean-François Malherbe by involving a part of his closest colleagues and pupils on topics that are central to different subfields of ethics as well as to philosophy, theology, and social and normative discussion. The issues analyzed coincide, in some cases, with topics on which Malherbe offered his own scientific contribution and, in some other cases, with interests, ideas, and projects realized or to be realized by him in collaboration with the authors of the essays included here.

Some people with dementia are transformed by the disease, to the point that family members may describe them as a “different person.” These transformations may be negative or positive. What factors affect the judgements of ordinary people about whether an advance directive (AD) should be followed in such cases? We conducted three studies to test the influence of (1) positive versus negative transformation and (2) “treat” versus “withhold treatment” AD on the judgements of US participants (n = 1676) as to whether the AD should be followed and the extent to which the late-stage dementia patient had become a different person. We found that participants generally endorsed following the AD, irrespective of condition, but much less so when the patient had a positive transformation. Participants also favored “treat” over “withhold treatment” ADs. Unexpectedly, we found that AD type affected “different person” judgments: participants registered significantly weaker agreement with the proposition that the patient had become a different person when the AD instructed treatment. We discuss these results in the context of Walsh’s (2020) newly proposed normative model for AD decision-making.

Increasing life expectancy results in growing numbers of patients with chronic illnesses expanding the use of technologies for extending life (although some would say this comes, at times, at the expense of quality of life). Therefore it is becomes increasingly important to raise patients’ and caregivers’ awareness of the right to receive medical treatment that accords with their preferences. This article describes the need for more widespread and effective use of advance directives for planning medical treatment in Israel in accordance with the wishes of the patient, in situations where the patient is no longer unable to make independent decisions and express his autonomous will.
The principle of respect for autonomy in medical treatment process has long been anchored in Israeli law, including express directives on the use of advance directives. Even so, as in other Western countries, there remains a gap between legal recognition (important in and of itself) and its translation into practice.
This article seeks to describe the situation as it currently stands in Israel. It will discuss existing law, obstacles to its proper implementation, and the implications of the current inadequate failures when advance directives are not properly used. It will also compare ways of dealing with the situation in Israel and the world. On this basis this article describes ways to improve the efficacy of advance directives and adapting treatment to the individual patient. Further, the article presents an innovative program currently being advanced by the Life's Door Association (Gisha LaHayyim) for encouraging more widespread use of advance directives by making advance directive forms, including psycho-social and power of attorney forms, part of the computerized medical documentation process.
 

במציאות שבה תוחלת החיים מתארכת, כשרבים סובלים ממחלות כרוניות וגובר השימוש באמצעים טכנולוגיים המסייעים להארכת משך החיים (אך לעיתים תוך מה שנחזה בעיני רבים כפגיעה באיכותם), נודעת חשיבות יתרה להגברת המודעות בקרב מטופלים ומטפלים לכך שהם רשאים לקבל טיפול רפואי בהתאם להעדפותיהם. מאמר זה מתאר את הצורך ביישום והטמעה של שימוש בהנחיות מקדימות ככלי המאפשר תכנון טיפול רפואי והתאמתו לרצון החולה, במצבים שבהם החולה חסר יכולת לקבל החלטות באופן עצמאי ואינו יכול להביע רצונו האוטונומי.
עיקרון כיבוד האוטונומיה של החולה במסגרת ההליך הרפואי עוגן זה מכבר בדין הישראלי, הכולל אף הנחיות מפורשות באשר לשימוש בטפסי הנחיות מקדימות. אף על פי כן, בדומה למדינות מערביות אחרות, קיים עדיין פער בין ההכרה החוקית (החשובה מאוד כשלעצמה) לבין המתרחש בפועל.
המאמר מבקש לתאר את תמונת המצב הקיימת בישראל, תוך התייחסות לדין הקיים ולחסמים המעכבים יישומו כראוי, לדון בהשלכות של העדר שימוש בהנחיות מקדימות ולהציע עיון משווה באשר לאופן ההתמודדות עם המצב בישראל ובעולם. על רקע אלו יוצגו בסיום המאמר חלופות לייעול השימוש בהנחיות מקדימות והתאמת טיפול לחולים, ותוצג בפירוט תכנית חדשנית המוצעת בימים אלו ביוזמת עמותת גישה לחיים, להטמעה מיחשובית של טפסי הנחיות מקדימות הכוללים טופס פסיכו סוציאלי ומינוי מיופה כח.

En los últimos años se ha incrementado en Argentina la cantidad de tratamientos de reproducción asistida con donación de gametos (óvulos y/o espermatozoides). La filiación por técnicas de reproducción asistida heterólogas interroga la tradicional “herencia de sangre” objeto de estudio privilegiado de las ciencias sociales. En las últimas décadas, el paradigma sobre el anonimato de los donantes ha cambiado en muchos países. A su vez, se ha sugerido que los rápidos y generalizados avances en las pruebas genéticas podrían modificar las políticas de anonimato. ¿Cuáles son las consecuencias de fundamentar la revelación de la información genética/identificatoria sobre la
base del mayor acceso que posibilitan los test genéticos? La presente reflexión parte de dos vertientes: la pública –que analiza las paradojas que encierra el articulado del nuevo Código Civil y Comercial (2015) – y la íntima, que ubica las coordenadas sobre las que se inscribe la transmisión singular de los orígenes.
