This chapter books examines critically how the mining legal framework in Colombia was set up in a postcolonial context which in turn is strongly connected with the neoliberal turn. Focusing on a conflict between gold small-mining and large-scale mining, this chapter analyses the continuities and discontinuities of the legal mining regime with our colonial past in the framework of the Colombian Constitutional State.
