This article examines the discriminatory legislation which prohibits same-sex couples from adopting children in many... more This article examines the discriminatory legislation which prohibits same-sex couples from adopting children in many jurisdictions. New South Wales is used as a case study to highlight inconsistencies between the treatment of heterosexual prospective parents and same-sex parents. This is contrasted with the legal recognition of same-sex parents pursuant to recent amendments to the Federal Family Law Act 1975 and various State Acts.

Purpose: The purpose of this explanatory study is to determine the factors that contribute to increased support for state constitutional amendments banning same-sex marriage in each of the fifty United States. Scholarly literature suggests that the determinants for level of support for state constitutional amendments banning same-sex marriage are: the percentage of the state’s population identifying religion as an important part of their daily lives, the percentage of the population, age twenty-five and older, without a college degree; the percentage of the state’s population identifying as politically conservative; the percentage of the state’s population residing in rural areas; the percentage of the state’s population age sixty-five and over; and the percentage of the state’s population that is male. Six hypotheses were developed to test each of these factors.
Methodology: This study used existing data to assess how each of these factors impacted the level of support for states’ constitutional amendments banning same-sex marriage. Multiple regression analysis was used to analyze the data, determining whether the hypotheses were supported or rejected.
Results: The results showed that after controlling for other possible intervening factors, only one of the independent variables, level of Religiosity within the state, was significant.
Conclusion: The hypothesis that higher level of religiosity in a state leads to support for constitutional amendments banning same-sex marriage is supported by this study.

Il matrimonio omosessuale rappresenta un ambito privilegiato di confronto tra diverse visioni relative alla protezione dei diritti fondamentali e al bilanciamento delle competenze all’interno di
uno stato democratico.
Di fronte all’inerzia del legislatore su temi sensibili quali il matrimonio omosessuale (o scelte di fine vita), le Corti costituzionali e supreme hanno fornito copertura costituzionale a situazioni soggettive bisognose di tutela. In tal modo hanno dimostrato di aver compreso il significato insito nell’adozione di una Carta costituzionale rigida e di organi di giustizia costituzionale a tutela dei principi in essa codificati: la protezione di una serie di diritti inerentemente non-maggioritari dall’abuso della maggioranza. Obiezioni sono state sollevate tuttavia sulla legittimazione di organi che non godano di investitura democratica diretta a compiere scelte su temi sensibili con effetti sistemici. Tali obiezioni sono state superate alla luce di un dialogo delle Corti con il legislatore; in altri casi nell’inerzia dei Parlamenti, le Corti hanno svolto la funzione che è loro propria, di tutela dei diritti delle minoranze.
Il contributo offrirà un’analisi comparata delle decisioni delle Corti supreme di Canada e Stati Uniti, a livello federale e statale, in tema di matrimonio omosessuale.
