In this paper, I would like to argue that brain-dead small children have a natural right not to be invaded by other people even if their organs can save the lives of other suffering patients. My basic idea is that growing human beings have the right to grow in the form of wholeness, and dying human beings also have the right to die in the form of wholeness; in other words, they have the right to be protected from outside invasion, unless they have declared their wish to abandon that right beforehand. I call this the principle of wholeness. Natural rights, which were discussed by Hobbes and Locke in the 17th century, have to be extended to include the right to grow and die in the form of wholeness in the age of scientific civilization, where peripheral human lives are being threatened by aggressive biomedicine and other advanced technologies.

This article addresses everyday strategies of coming to terms with organ transplantation that we term normalization... more This article addresses everyday strategies of coming to terms with organ transplantation that we term normalization practices. The analysis is based on focus group discussions and ethnographic interviews with transplant recipients, their relatives and waiting list patients in Sweden, Cyprus and Germany. Exploring our respondents’ narratives we analytically differentiate between three levels of practices normalizing the post-transplantation experience: (1) a personal level, (2) a level of the intimate, and (3) a level of anonymous sociality. Our comparative perspective shows that sociocultural differences play a much greater role in interactive normalization practices (levels 2 and 3) than on the personal level (1), where universalized medical knowledge provides a framework that supersedes the role of cultural or social differences.

Durch den... more Die Transplantationsmedizin hat sich zu einem sehr erfolgreichen medizinischen Fachgebiet entwickelt. Durch den Organmangel wird dieser Erfolg jedoch eingeschränkt. Der Beitrag definiert den Organmangel als Problem der öffentlichen Gesundheit und untersucht auf dieser Grundlage die Frage, welche staatlichen Fördermittel die Verfügbarkeit von Organen erhöhen könnten. Nach einer Betrachtung des Status quo der Organtransplantation präsentiert der Beitrag die Idee einer Public Policy zur Förderung der Organspende. Im Rahmen einer solchen Public Policy kann der Staat Anreizinstrumente in der Form von Belohnungsmodellen einsetzen. Der Beitrag untersucht verschiedene Modelle und beantwortet die Frage, welche rechtlichen Rahmenbedingungen dabei berücksichtigt werden müssen.
