The... more This article is based on a fieldwork project conducted by the authors in the Muğla region of western Turkey. The region is the locale for a significant level of settlement by British people, within the wider context of settlement by groups of other EU nationals in western Turkey. Based on a series of interviews with British settlers and Turkish locals, it examines the factors which affect the process of legal adaptation of the former group. It identifies and discusses the place of British settlers within the larger Turkish legal order, their integration into Turkish life, and the extent to which different socio-legal disabilities and advantages affect this process. The article also casts some light on the extent to which, given the level of British immigration into the area, Turkish officialdom is prepared for their presence.

The so-called Arab Spring has thrown out of kilter the precarious balance on which the Euro-Mediterranean... more The so-called Arab Spring has thrown out of kilter the precarious balance on which the Euro-Mediterranean border-control regime as been built over the years, illustrating the need to set this regime on a new foundation. The breaking point in the crisis came when the flow of migrants landing on Italian shores in Lampedusa took a spike at the beginning of this year. I analyze how the Italian government manufactured the Lampedusa crisis by matching a discursive rhetoric to government strategy, and I highlight how the sovereign prerogative to define emergency was questioned at both a supranational and a subnational level. I also discuss the main assumption behind securitization theory, exploring the complex web of political and institutional relationships involved in the securitization process and illustrating the ambiguity of the security language deployed by the main securitizing actors. Finally, I look at the possible outcomes of the crisis by looking at the interests involved when it comes to reconfiguring the power to define and govern emergency within the framework of theEuropean border-control regime.

On se souvient que cette question a fait couler beaucoup d’encre suite aux propos du ministre Dewael, qui déclarait à la Gazet van Antwerpen le 7 janvier 2006: « l’illégalité est un délit. Et celui qui a connaissance d’un délit est légalement obligé de le signaler au parquet » . Que prévoit la loi sur le sujet ? Un petit rappel n’est sans doute pas inutile pour toutes les personnes qui défendent les droits des personnes en séjour illégal. Au lieu d’un exposé sec et indigeste de la législation, pourquoi ne pas tester ses connaissances sous forme d’un jeu-test, établi à partir de situations concrètes ? Il est conseillé de répondre à toutes les questions (il n’y a qu’une seule réponse correcte) avant de se reporter aux réponses commentées qu’on trouvera plus loin.

En... more Pour un étranger, la décision d’octroi d’un séjour n’est pas toujours synonyme de la fin des tracas administratifs. En effet, il faut encore obtenir un titre de séjour auprès des autorités communales pour que la situation soit définitivement stabilisée. Ce qui devrait n’être qu’une formalité simple et rapide se transforme souvent en nouveau parcours du combattant. Dans un premier temps, on décrira les différentes étapes de ce parcours. On observera que les exigences formulées par les communes s’avèrent parfois contraires à la réglementation. Dans un deuxième temps, nous tenterons de lister les conséquences parfois graves sur les droits des personnes que provoquent les retards ou les blocages (intentionnels ou non). Une attention particulière sera consacrée à certains droits sociaux (santé, allocations familiales, aide sociale). Enfin, nous donnerons des pistes pour remédier aux dysfonctionnements observés. Tant les démarches administratives que les procédures judiciaires seront abordées.

La libre circulation en Europe est devenue une réalité palpable pour de nombreuses personnes. Pour les étrangers et ceux qui les conseillent, elle est souvent source de confusion. Parce que les contrôles aux frontières sont devenus l’exception, d’aucuns peuvent penser que les frontières ont disparu. Dans ce dossier, nous tentons de faire le point sur les possibilités de voyage et d’installation à l’intérieur de l’UE pour les personnes qui séjournent légalement dans un Etat membre, sur base des sources juridiques européennes et belges . L’examen des possibilités concrètes de déplacements et d’installation au sein de l’espace européen montre une situation infiniment complexe. Pour les citoyens européens, et les membres de leur famille (qui répondent à la définition du droit européen), la tendance est très clairement à l’abolition des obstacles et à la souplesse, même si ce n’est pas toujours évident à faire respecter en pratique. Par contre, pour les ressortissants de pays tiers qui ne sont pas membres de la famille d’un citoyen de l’UE, la libre circulation reste souvent un concept impraticable ou un jeu dangereux. Alors que la frontière semble avoir quasiment disparu, elle peut subitement et sournoisement réapparaître avec plus de force, à l’intérieur du territoire sous forme de contrôle et de détention. Dans l’état actuel de la réglementation, il faut évacuer l’idée que les ressortissants de pays tiers bénéficient du gâteau européen de la libre circulation. En réalité, ils n’en reçoivent que quelques miettes.

This article examines how the adoption of children under Hindu law in India is regarded by British private international law and immigration law. Through an analysis of case-law, it focuses particularly on how British judges regard the legitimacy of exclusion by the British immigration control system of children who have been adopted under a ‘foreign’ legal system which essentially permits private adoption arrangements. Examining the background to the regime of Indian Hindu law adoptions (which applies to Sikhs aswell asHindus), and the private international law and immigration rules which apply to such adoptees in the UK, the article finds some evidence in the judicial decisions of a more activist, human rights-based, plurality-conscious position being taken. However, tracking the case-law further, the article
concludes that such activism has not been followed through in more recent decisions leaving the conflictual position between transnational adopters and British legal systems largely unresolved.

Le cosiddette rivolte Arabe hanno distrutto il precario equilibrio su cui negli ultimi anni era stato costruito il... more Le cosiddette rivolte Arabe hanno distrutto il precario equilibrio su cui negli ultimi anni era stato costruito il regime di controllo della frontiera Euro-mediterranea. Il punto di rottura è stato senza dubbio l'aumento di sbarchi sulle coste italiane a partire dal gennaio 2011 che ha innescato un complesso dibattito a livello europeo sulla necessità di riformare la Schengen governance. L'articolo analizza come il governo italiano abbia letteralmente "prodotto" la recente emergenza sbarchi attraverso la sua retorica discorsiva e le sue prassi di governo della frontiera, illustrando anche come la prerogativa sovrana di definire l'emergenza sia stata messa in questione tanto a livello sovra-nazionale che a livello sub-nazionale. L'analisi è svolta a partire da una discussione dei principali assunti della teoria della securitarizzazione e punta ad analizzare il complesso reticolo di rapporti istituzionali e politici all'interno del quale si è svolto il processo di produzione dell'emergenza. In conclusione l'articolo discute i possibili esiti della crisi del regime confinario Europeo, analizzando le proposte per una ridefinizione del meccanismo di governo del sistema Schengen recentemente avanzate dalla Commissione e dal Consiglio dell'Unione europea.
