Did the same laws which apply off-line also apply in “cyberspace”? How connected is the virtual world to the real world, and can the governments which so effectively assert control over the latter do the same for the former? If they do, should we rejoice at the extension of the rule of law to another realm, or should we mourn lost freedoms? Should we be looking for analogies between on-line and off-line activities, or insisting on the distinctiveness of the virtual? And where does all of this leave the claim that there is such a thing as “Internet Law”?

Dans son dernier livre, Alain Strowel analyse les enjeux juridiques autour des services en ligne proposés par Google. La thèse principale du livre est que lorsqu'un acteur aussi incoutournable que Google défie le droit, il participe à l'écriture du droit de l'Internet. Les innovations introduites par le géant américain ont souvent suscité d'intéressants développements dans la jurisprudence, qui servent de fil rouge au propos de l'auteur.
Après avoir résumé les principaux chapitres, nous ferons un commentaire critique sur un ouvrage couvrant de manière pédagogique et stimulante une large palette de thématiques du régime juridique des droits intellectuels dans l'environnement numérique.

Governments and big private companies collect huge amounts of data that represent a strategic and economically relevant asset. The predictive relevance of big data management and the global dimension of this phenomenon has led us to reflect on the nature and the dynamics of a centralized power held by only a few subjects. The increasing power that derives from big data necessitates the adoption of adequate remedies to control and limit the information asymmetries and their consequences in terms of economic advantages and social control. From this perspective it is important to adopt adequate measures to control those who have this power, in order to limit possible abuse and illegitimate advantages, and, at the same time, to increase access to information, in order to spread informational power.

This paper emphasises the key role played by Internet Service Providers (ISPs) in the current developments in Internet... more This paper emphasises the key role played by Internet Service Providers (ISPs) in the current developments in Internet content regulation. At present, no common international standards govern free speech limits on the Internet. Racist speech constitutes the most controversial issue between Europe and the US. The enforcement of domestic law online has recently led to surprising court rulings in several European countries, putting transatlantic ISPs under pressure. The paper provides a detailed account of three of these cases: the early German Compuserve case, the famous French Yahoo! case and most recently the French J’accuse! case. Both European and American legislators have endeavoured to provide ISPs with “safe havens” (limitations of liability) and tentative procedural solutions like “notice and take down”. These new regimes and their likely effects on ISPs are presented and discussed. It is suggested that, despite the lack of common standards, the combination of the American and the European provisions would strongly incite transatlantic ISPs to take down racist material. This, however, also risks affecting other controversial data, otherwise subject to free speech protection. The danger of a massive scheme for private censorship is compelling.

Current regulations and policy initiatives concerning the use of copyright contents in the Internet in multiple... more Current regulations and policy initiatives concerning the use of copyright contents in the Internet in multiple countries have generated strong lobby processes which include a media campaign between the different agents who consider these regulations essential for their interests. The entertainment industry argues that some uses of new technologies are a risk for their business and because of that they lobby for strong policies against piracy and the free use of content by search engines. The Internet Service Providers (ISP) do not want to assume the supervision cost of internet users´ behaviour although they would like to participate in the profits of the digital content business. Activists believe that regulation proposals and policies threaten fundamental rights such as personal privacy, freedom of speech, free circulation of information and knowledge as well as the right of Internet access. In this paper we focus our attention in the case of UK and Spain and the media visibility of actors who are part of this conflict. We assess if different sides in the conflict have the same media visibility in order for their statements to be followed by the public opinion. We draw upon a content analysis of documents on multiple online channels (organization web sites, news and blogs) and we do a network analysis in order to identify hyperlinks between the sites of the organizations involved in the conflict. In this way we identify the visibility of the policy agents on the Web and asses if there is a correlation between the visibility on the different online spheres (blogosphere, news sphere, web sphere, social network sphere). We find that visibility levels depend on the agents profile and the contextual features of the countries that we analyze.

As a consequence, the... more Most e-commerce applications require the collection and storing of information about customers. As a consequence, the performed transactions involve legal issues. For three years, the authors have been involved in a project that studies the potentials of personalization of e-commerce systems from the particular angle of SMEs. The paper picks up a couple of scenarios that many e-commerce vendors face when implementing personalization on their Web sites. The specific focus of the discussion is the legal use of costumer profiles for e-commerce applications. Since most legal issues are difficult to understand for non-lawyers the paper makes use of a case study, which shows explicitly what e-commerce vendors need to keep in mind when implementing personalization on their Web sites.

Co-regulation offers the... more Chris Marsden argues that co-regulation is the defining feature of the Internet in Europe. Co-regulation offers the state a route back into questions of legitimacy, governance and human rights, thereby opening up more interesting conversations than a static no-regulation versus state regulation binary choice. The basis for the argument is empirical investigation, based on a multi-year, European Commission-funded study and is further reinforced by the direction of travel in European and English law and policy, including the Digital Economy Act 2010. He places Internet regulation within the regulatory mainstream, as an advanced technocratic form of self- and co-regulation which requires governance reform to address a growing constitutional legitimacy gap. The literature review, case studies and analysis shed a welcome light on policymaking at the centre of Internet regulation in Brussels, London and Washington, revealing the extent to which states, firms and, increasingly, citizens are developing a new type of regulatory bargain.
