The case application is CISG which applies to contracts between sellers and buyers. The CISG used the provision key of Articles 4, 35 and cited to Article 36.
Usnior requested a meeting with Caterpillar to present new type of sales pitch steel called “Creusabro 8000” which was harder, stronger, welded, better and can stand the high heat. Based on these representations from Usinor, Caterpillar submitted proposals to its customers to manufacture dump trucks using the Creusabro steel. In later sales presentations, Leeco joined the Usinor. Caterpillar made some transactions to their customer in various locations in U.S. and negotiated with Usinor Industeel (Usinor), a French steel company, and its own Mexican subsidiary, Caterpillar, Mexico (hereafter CMSA) for the supply of steel to CMSA so that CMSA could use the steel in the manufacture of the truck bodies. Caterpillar also contracted for truck bodies manufactured with the Creusabro steel from an independent company called Western Technology Services International, Inc. (Westech) a compnay unrelated to Caterpillar.
Caterpillar subsequently delivered new trucks to its customers. There were no problems with the trucks delivered in the first shipment, but the bodies in several of the trucks delivered in subsequent shipments was cracked.
Accordingly, the case start to take place from defective steel supplied by Usnior to Caterpillar and truck bodies manufactured by Westech had the same defects as those manufactured by CMSA. In addition, the steel quality proved to be low quality and more difficult to use than CMSA had been led to believe it would be so CMSA incurred higher than expected costs in manufacturing the truck bodies.

El subsector del agua potable y el saneamiento urbano en México exhibe, por una parte, resultados positivos en materia de coberturas de agua y alcantarillado. Sin embargo, el desempeño de la mayor parte de los sistemas sigue siendo técnica y administrativamente deficiente, a pesar de la sucesión de políticas públicas que han buscado, mediante la transformación del marco institucional formal, modificar y propiciar el desarrollo de los sistemas de agua potable del país. En este documento se ensaya un análisis preliminar de la evolución del marco institucional desde un punto de vista cognitivo, es decir, que considera que las políticas públicas resultan de la interacción de un conjunto de actores con representaciones y discursos divergentes dentro de un campo de fuerzas específico, y no de una concepción “racional” basada en la determinación de objetivos sociales, la evaluación de alternativas, su implementación y adecuación. En la evolución institucional del subsector del agua y saneamiento urbanos habría influido, principalmente, la interacción de marcos de interpretación diferentes y la consiguiente reacción de los actores, en función de los desafíos y oportunidades que perciben para sus
posiciones relativas. Se hace una identificación preliminar de los elementos del análisis cognitivo de políticas públicas, basada en el material testimonial recabado en una publicación reciente sobre el agua potable en México, con objeto de sugerir perspectivas a partir de las representaciones y discursos que parecen guiar la discusión actual en el tema, así como proponer vías de exploración más profunda de análisis con este tipo de enfoque. Se sugiere también que la construcción intencionada de espacios para hacer confluir los marcos de interpretación de
la realidad puede abonar a favor de una reforma eficaz del subsector.

The analysis of the market constitutes perhaps one of the most controversial aspects in the study of economic systems.... more The analysis of the market constitutes perhaps one of the most controversial aspects in the study of economic systems. In fact, such analysis lies at the juncture of significant aspects of economic and social structure: in particular, public action and private initiative, forms of competition, and the related concepts of capitalism, socialism, sustainable development, participation and democracy. In order to enquire into these complex relations, we employ, in an interdisciplinary and pluralistic perspective, a number of contributions from institutional economics and other social and psychological theories. In the analysis of such issues, these theories can contribute to shed light on the following intertwined aspects: (1) the structure of collective action; (2) the relations between market and nonmarket arrangements; (3) the nature of market failures and imperfections; (4) the problems of coordination between the various policies bearing on the market structure, which are also considered in their supranational dimension and, thus, offer insights useful to the development of a green economics methodology. In this perspective, a closer collaboration between green economics and other pluralistic-oriented strands of social sciences can contribute to the formulation of policy strategies which are more able to integrate the aims of environmental and social justice.

Guanajuato State, located in central Mexico, with less than 2% of the countrys area, has almost 17,000 deep water... more Guanajuato State, located in central Mexico, with less than 2% of the countrys area, has almost 17,000 deep water wells, from which nearly 4,000 cubic hectometers (hm3) per year are being extracted, more than 1,000 hm3 over the estimated renewable yield. Since, in Mexico, water is administered under federal jurisdiction by the National Water Commission (CNA, for its Spanish acronym), the state government faces the challenge of ensuring its populations economic development without formal means of intervention. Being thus limited to apply mandatory policies and measures, the state water program has focused on the implementation of a two-sided strategy. First, basic hydrogeological studies and mathematical groundwater hydrodynamic models were developed upon a comprehensive survey of existing wells and a general revision of the states geological framework. Second, a structure for water users participation in water management actions was promoted (from the dissemination of information to the implementation of pilot efficient water use projects) with financial, technical and political support from the state. Simultaneously, a coordinated effort towards the completion of the water users registry was performed with the federal authority along with other supporting measures such as training and monitoring programs. In this paper, a general overview of the projects achievements and challenges is presented.
