An increasingly popular business practice, data mining provides or the extraction of information from existing data to identify trends such as consumer purchasing practices and can foster greater efficiency in companies’ marketing efforts. There are corresponding costs associated with data mining, as well. The most difficult issue surrounding data mining is that of individual
privacy rights and the costs associated with the potential alteration of ‘traditional’ privacy rights. This paper seeks to review basic definitional information on data mining and provide a strategy for companies’ successful, meaningful and ethical use of data mining as presented for meaningful knowledge
generation.

Humans need not justify terrorism of any kind, regardless of whether one is Muslim, Christian or Jew, because it is... more Humans need not justify terrorism of any kind, regardless of whether one is Muslim, Christian or Jew, because it is the axis of evil and devastation of mankind. However, the deliberate use of the term terrorism in recent decades was carefully selected, mainly, against a certain religion (Islam). The idea was then globally politicized by the Western world. Leaving that scholarly view in its own right, we disagree with the opinion raising terrorism as the devil’s just-born child of evil, when in reality Africans had been terrorized for centuries as slaves and human chattel. Hence the basis for the concept of this thesis: conceptualizing the episode of ‘terrorism’ and ‘terrorist’ from the broader perspective of its practice from the Middle Passage or the Atlantic Slave Trade. To portray that argument and broaden the scope of the debate over this critically sensitive subject, we divided the discussion into three sections: an examination of what constitutes terrorism and terrorist; history of terrorism and terrorists from an Africa perspective; and the ideological constraints within the subject of terrorism as practiced by the US and its Western allies.

The European Convention on Human Rights does not explicitly protect the right to work; nevertheless the ECHR case law... more The European Convention on Human Rights does not explicitly protect the right to work; nevertheless the ECHR case law protects aspects of this right. The paper summarises the content of the right to work and then demonstrates how the case law protects aspects of it. Article 8 can be used to protect the right to seek employment, while Articles 6 and 8 can be used to combat unfair dismissal. Other ECHR Articles prohibit discrimination. The paper concludes with some suggestions as to how to develop this trend in the case law. First, Article 8 should be recognised as protecting the negative aspects of the right to work. Second, the relationship between Article 8 and Article 14 needs clarification. Third, there is scope to develop positive obligations in relation to the right to work

La doctrine récente en théorie et en philosophie du droit examine depuis plusieurs années les transformations du droit dans la mondialisation à partir de l’hypothèse de la formation d’un droit global. Les codes de conduites constitueraient un élément typique de ce droit global naissant.
Confrontés au phénomène massif de multiplication des codes de conduite, considéré comme extérieur au droit, selon la théorie et les critères classiques des normes juridiques, mais qui évolue pourtant en interaction sinon en concurrence avec lui, les auteurs examinent dans cette contribution le problème des rapports entre codes de conduite et sources du droit. Ce problème se décline en deux questions distinctes, mais complémentaires, qui sont traitées successivement. Premièrement, les codes de conduite constituent-ils ou seraient-ils susceptibles de constituer une source formelle du droit et, dans l’affirmative, laquelle ? S’agit-il d’une source spécifique, sui generis, ou peut-on finalement la ramener à des sources connues comme la convention, l’usage ou d’autres solutions encore ? Deuxièmement, dans quelle mesure les codes de conduite nous invitent-ils à repenser la théorie des sources, à éventuellement modifier ou compléter notre compréhension de ce concept, voire, et c’est vers cette option plus radicale que les auteurs inclinent, à remettre en cause la pertinence de la notion de « sources du droit », sa capacité à rendre compte d’un phénomène normatif, qui s’inscrit dans une logique qui fondamentalement différente de l’approche du droit par les sources ?

This paper examines the role of vulnerability in the basis of business ethics by criticizing its role in giving a morally substantial character to fiduciary duties to shareholders. The target is Alexei Marcoux's (2003) argument for morally substantial fiduciary duties vis-à-vis the multifiduciary stakeholder theory. Rather than proceed to support the stakeholder paradigm, a conception of vulnerability is combined with Joseph Heath's (2004) "market failure" view of the ethical obligations of managers as falling out of their roles as professionals involved in the institution of the market. The
result is the core of a theoretically defensible and managerially motivating and deployable ethic.

The idea of a regular income that allows people to plan and fulfil a life project is a certainly linked to the topic of job markets reform. However, these two issues do not overlap. The reform of job contracts, new economic incentives, liberalization and tax exemptions can make the job market more efficient, but all these tools can not resolve the issue of effective risk of insecurity and irregularity in personal incomes.
Guaranteeing incomes is not the same than guaranteeing jobs: if the issue of income security involves the workers, the precariat, the unemployed, all the young men and women looking for their first job, it does not concern them as workers but as citizens. Or, to put it more precisely, as people with fundamental rights.

Il tema della garanzia al reddito è certamente legato a quello del mercato del lavoro e della sua riforma, ma non ci si può illudere che coincida con esso. La modifica delle forme contrattuali, gli incentivi economici, le liberalizzazioni e le defiscalizzazioni, anche quando portassero ad un più efficiente mercato del lavoro, non risolverebbero comunque la questione della sempre possibile intermittenza del reddito.
La garanzia del reddito non è perfettamente sovrapponibile alla garanzia del posto di lavoro e, pur interessando lavoratori, disoccupati, ragazzi e ragazze in cerca di prima occupazione, essa non li riguarda come semplici lavoratori o aspiranti tali, ma in quanto cittadini, o più precisamente, in quanto persone titolari di diritti fondamentali.
