It... more The debate surrounding the nature of ‘Europeanisation’ has been raging in the European Union for a number of years. It raises a variety of issues regarding the impact of the EU and its effects on the domestic politics and institutions of Member States. In terms of labour law, the European Union has, over the years, attempted to ‘Europeanise’ national labour law systems directly and indirectly by introducing measures under the banner of ‘European Labour Law’. However, there has always been a debate on the success of such measures as well as on the existence of a category of ‘European Labour Law’. This article examines the debate surrounding the Europeanisation of the German and British labour law systems. Germany and the UK have been chosen as focal points as the different labour law systems illustrate the wide spectrum of national systems of regulation that European Labour Law must take into account in order to achieve some measure of harmonisation. The paper therefore suggests criteria for testing the success which measures of European Labour Law have attained in attempting to Europeanise the national labour law systems. These criteria are borrowed from the sphere of comparative labour law.

Drawing on the... more This article examines the problem of divergent judicial interpretation of harmonized documents. Drawing on the experience of harmonization of the law of arbitration, it points out that divergent interpretation runs much deeper than is commonly assumed, and shows strong similarities to the ‘transplant effect’ discussed in the literature on legal transplants. The article examines why the transplant effect shows up in harmonization, and considers its importance for the eventual success or failure of harmonization projects.

Analysis of the emergence of judicial supremacy within American politics, as shown in the work of Whittington, reveals... more Analysis of the emergence of judicial supremacy within American politics, as shown in the work of Whittington, reveals the important role played by political actors and particularly the presidency in the formation of the Supreme Court’s power. This dissertation builds on Whittington’s work regarding judicial supremacy but differs in the extent to which it emphasises the salient role of judicial agency in the formation of the Court’s authority. Judicial agency sees the Court as a political actor making calculations in the context of the prevailing circumstances and adopting strategies to maximise its authority. The relationship between the Supreme Court and the presidency defies easy categorisation, yet the political benefits to presidents of the Court’s ability to render favourable rulings on preferred policies appear to outweigh the undeniable disadvantages which have accrued to presidents from their recognition of judicial authority.

The Separation of Powers is a bedrock doctrine. This paper explores the rationale supporting this resilient doctrine as well as the historic and current struggles the United States and India each has had in maintaining this balance.
Both countries have had difficulty setting the exact contours of this separation, a task made more difficult given the rough and tumble of political reality, sometimes including war. Today, these two great democracies – the oldest and the largest – still struggle to get the balance right, in order to ensure liberty and to prevent the exploitation toward which unchecked power naturally drifts.

This paper examines the diverse responses of the German states to the Code Napoleon at the beginning of the nineteenth... more This paper examines the diverse responses of the German states to the Code Napoleon at the beginning of the nineteenth century. These states differed both in the extent to which they adopted the Code, and the extent to which they retained the Code after Napoleon’s influence waned. In order to identify the causes of adoption and retention of the Code, we use fuzzy-set qualitative comparative analysis (fsQCA). This method is now well established in comparative research in the social sciences but has been little used in comparative legal analysis. We find the following to be among the conditions relevant to the reception of the Code: territorial diversity, control by Napoleon, central state institutions, a feudal economy and society, liberal (enlightented absolutist) rule, nativism among the governing elites and popular anti-French sentiment. The paper also serves to demonstrate the potential of fsQCA as a method for comparative lawyers.

Das Gesetz der Republik Weißruss-land „Über die Schiedsgerichte“, wel-ches am 24.06.2011 von der Nationalversammlung und am 30.06.2011 vom Senat der Nationalversammlung genehmigt worden ist, sollte zur Unterschrift beim Präsidenten vorgelegt werden. Jedoch bestanden Zweifel an der Verfassungsmäßigkeit von ebendiesem, weshalb es vor der Unterzeichnung durch den Präsidenten dem Verfassungsgericht (VerfG) vorgelegt worden ist.
Das Gesetz selbst regelt die Grün-dung und die Tätigkeit von nationalen Schiedsgerichten. Es enthält Voraussetzungen für den Abschluss von Schieds-vereinbarungen, die Regeln zur Füh-rung des Prozesses, so wie Regeln zur Vollstreckung von Schiedssprüchen . Hervorzuheben ist, dass dieses Gesetz lediglich für die nationale, jedoch nicht für die internationale Schiedsgerichtsbarkeit gilt.

So wie in der Russischen Föderation, so sind auch in der Ukraine die Arbeitsgerichtsbarkeit und das Prozessrecht nicht gesondert geregelt, sondern Bestandteil des Arbeitsgesetzbuchs (ArbGB). Im Anschluss an den Beitrag über das ukrainische Individualarbeitsrecht, widmet sich dieser Artikel dem gerichtlichen Individualechtsschutz, der ebenfalls·im Arbeitsgesetzbuch geregelt ist. Die Verfahrensregeln beinhaltet das 15. Kapitel. Grundsätzlich sind drei verschiedene Arten des Rechtsschutzes im Fall von individualarbeitsrechtlichen
Streitigkeiten vorgesehen.

Das ukrainische Arbeitsgesetzbuch (ArbGB), das zurzeit in der Ukraine gilt, fußt noch immer auf dem alten sowjetischen Arbeitsrecht und ist, obwohl zahlreiche Änderungsgesetze
verabschiedet wurden, heute fast 40 Jahre alt. Aus diesem Grunde bevorzugt es Arbeitnehmer und bietet diesen den größtmöglichen Schutz. Hinzu kommt. dass der Arbeitnehmer
durch den Arbeitsvertrag über seine Rechte nicht verfügen kann, Folglich werden die Vorschriften des ukrainischen Arbeitsrechts den arbeitnehmerunfreundlichen Vereinbarungen des Arbeitsvertrags vorgeben. Dies wird dann besonders relevant, wenn es um Kündigungen geht. In diesem Fall erlaubt das ukrainische Arbeitsrecht die Kündigung des Vertrages nur unter bestimmten Umständen.

Every legal term has a specific meaning. In order to
determine the meaning of a given legal term, regard has to be made, inter alia, to the context in which it is used (systematic interpre-tation).
A given legal term may thus have different implications, depending on the context (specifically: the legal “framework”) in which it is used. Correspondingly, the meaning of the legal term “piercing the corporate veil”, which is the core aspect of this essay, is also relative.
This essay seeks to name certain areas of the law in which the term is used and to highlight and describe its context-specific meaning and to show its evolution in investment arbitration deriving from a mainly common approach with commercial arbitration.
