Irregular Migration

MIGRATION covers many types of migrants including explorers, slaves, pilgrims, mineworkers, labourers, exiles, refugees, sex workers, students, tourists, retirees and expatriates. Between 2016 and 2019 irregular migration by North Africans to Europe increased noticeably. The rising numbers are driven by economic pessimism, social frustration and structural inequality. Old routes, which stretch from North African to European shores, have resurged in popularity. While some North African migrants engage with smugglers to take them north, a growing number are opting to organise their trip themselves, buying boats and heading for Europe. This dynamic has changed the politics around migration for both North African governments and those European nations offering aid.

En los últimos cuatro años, la crisis de los refugiados se convirtió en el tema excluyente de la Unión Europea (UE). Sin embargo, mientras la llegada masiva de inmigración clandestina compuesta de refugiados y solicitantes de asilo (asylum-seeker) dejó en evidencia tanto el ineficaz mecanismo normativo de asilo conocido como regulación de Dublín , como la escasa cooperación entre los países de la zona Schengen para alcanzar una armonización normativa común sobre la cuestión migratoria, la crisis de los ‘sin papeles’, es decir, de los inmigrantes irregulares que residen en el territorio de la UE, continuó sin cambios aparentes.

According to mainstream media and political discourse, human smugglers are among the cruellest figures of our time, individuals who prey on migrants’ need for assistance. Motivated by the circulation of this pejorative view in media and political discourse, I carried out ethnographic research with Syrian refugees and smugglers in Turkey, Greece, Jordan, and Lebanon with the ultimate goal of documenting what being a smuggler entails for the very actors of this unfolding drama. Fieldwork showed me how human smuggling was rooted in patterns of cooperation and support. And yet, most if not all my interlocutors, including the “smugglers” themselves, spoke of smuggling in negative terms. What I argue in this paper is that the smuggler, a category functional to the security apparatus, is not only manufactured within law enforcement circles and mainstream media, but even by those very people who are discriminated or targeted by states’ migration policies.

Essa pesquisa se dá no contexto das migrações internacionais contemporâneas, especialmente da migração indocumentada para os Estados Unidos. O ponto de partida é a violência contra migrantes na travessia pelo México, e as perguntas centrais são: se o migrante sabe do risco que corre com a violência no trânsito, por quê continua indo para os Estados Unidos? Como atuam as redes sociais na reprodução dos fluxos migratórios? Qual o vínculo existente entre a política migratória e a violência? Por quê os Estados controlam e restringem a migração, se há uma demanda pelo trabalho dos migrantes? Todas essas perguntas confluem para uma só problemática que são as relações de causalidade entre indivíduo e meio social na determinação do ato de migrar, combinadas com as relações de causalidade que levam à violência contra migrantes no México, estabelecendo o nexo entre política migratória e violência. A metodologia se baseia no método documentário e na sociologia reflexiva da migração de Sayad. As principais ferramentas da pesquisa de campo foram a observação participante e as entrevistas em profundidade. O percurso teórico faz uma revisão das teorias das migrações para chegar à teoria dos sistemas migratórios, ao funcionamento das redes sociais, e ao mito da elghorba como constituinte da violência simbólica na migração. O cenário da migração de trânsito pelo México é construído com o contexto geo-histórico da fronteira entre México e EUA, a conformação do México como país de trânsito dentro da regionalização das políticas de segurança continental e a análise detalhada das rotas utilizadas pelos migrantes centro-americanos. A violência simbólica nessas rotas é documentada a partir de entrevistas feitas em 2012 durante a Caravana de Mães Centro-americanas em busca de seus filhos desaparecidos. Em seguida, é construído o cenário da emigração brasileira para os EUA, tomando dados gerais e tomando a região de Governador Valadares como estudo de caso, observando a variação da cultura migratória entre o núcleo urbano e os municípios rurais próximos. A emigração brasileira indocumentada para os EUA é analisada em profundidade, observando como surgiram os primeiros mecanismos para favorecer a entrada de migrantes nos EUA e como eles foram se desenvolvendo conforme a migração foi constituída como desvio, até se consolidar a rota de trânsito de brasileiros pelo México. Dentro disso, é analisado criticamente o papel cumprido pela CPMI da Emigração em 2005 e 2006. O massacre de 72 migrantes no norte do México em agosto de 2010 é o ponto de partida para se analisar as relações entre violência contra migrantes e política migratória, observando o significado da guerra às drogas no México e o conluio entre crime organizado e autoridades públicas no estado de Tamaulipas como quadro para analisar de maneira ampla o significado da violência contra migrantes no México.

The notion of ‘risk of absconding’ in asylum and immigration law of the European Union The notion of ‘risk of absconding’ in EU asylum and immigration law appears in the context of restraining the freedom (detaining) third country nationals in whose respect either proceedings for return or proceedings for granting international protection are pending. Even though certain elements of the notion’s definition have already been explained by the Court of Justice, the Member States still take advantage of the discretion they have in determining the national catalogues of criteria evidencing the risk of absconding, while national courts do not interpret them in the same way in cases where the facts are similar. This article aims to present the rules of interpreting the notion, developed by the Court of Justice and the European Commission, in the context of judicial review of national measures when it is necessary to determine whether the risk of absconding exists.

The article deals with Germany's political, legislative and administrative reactions to the "refugee crisis" in 2015 and 2016 and traces the expected outcome of a series of restrictive regulations, which, however, were rather unexpectedly accompanied by liberal regulations in the area of integration. It is also shown that the special challenges have also led to considerable administrative modernisation.
